Craig Perkins

The Honourable Craig Perkins is counsel at Martha McCarthy & Company LLP, offering mediation and arbitration of family law disputes and related matters.

For over 40 years, Craig has been a respected member of the family law community, known for his expertise and judgement. He has been devoted to and at the centre of improving and applying the law relating to families and children in Ontario. In his mediations and arbitrations, he provides a flexible, individualized process, tailored to the specific needs of each family. As counsel to the firm, Craig draws on his extensive experience to provide guidance and strategic advice to his colleagues and their clients.

Craig graduated from the University of Toronto, Faculty of Law in 1972. He articled at and practised in the banking and litigation departments of Blake, Cassels & Graydon before joining the Ontario Ministry of the Attorney General, Policy Development Division in 1975. There he played a leading role in the development, drafting, and implementation of important Ontario family and civil justice legislation, including:

  • Marriage Act (1977);
  • Succession Law Reform Act (1977);
  • Unified Family Court Act (1977);
  • Family Law Reform Act (1978);
  • Courts of Justice Act (1984);
  • Rules of Civil Procedure (1984);
  • Family Law Act (1985);
  • Support and Custody Orders Enforcement Act (1986);
  • Courts of Justice Amendment Acts (court merger and reorganization, 1990; Family Court expansion, 1994); and
  • Family Law Rules (1999).

Craig represented the Attorney General in court in novel cases involving the interpretation and constitutionality of Ontario laws. From 1981 to 2004, he was a member of the both the Civil Rules Committee Secretariat and the Family Rules Committee Secretariat, which were responsible for all changes to the rules of Ontario courts.

Craig was appointed as a judge of the Superior Court of Justice in 1995, serving in Simcoe County Family Court for four years, in York Region Family Court for ten years, and in Toronto from 2010 to 2017. During his 22 years on the bench, he was a family law specialist and heard family cases almost exclusively. He wrote many important decisions in all areas of family law, from parenting to child protection to property and support.

As an active member of AFCC, the international association of family court professionals, Craig has gained perspective and understanding from disciplines other than law about the impact of separation, divorce, and parental conflict on children and parents. He is a contributing editor of the annual Ontario Family Law Practice, the go-to text for family dispute professionals looking for the relevant legislation, rules, cases, and practice guidelines.
